Is it legal to kiss lamp posts in the United States?

I was traveling home from work today along Wilshire Blvd near Doheny Drive and spotted a young man kissing a telephone pole. I snapped a camera photo and will upload it for sale on ebay, but don't want to get into trouble. Is this activity legal today?
